Our Funding Conditions outline what we expect of our funded partners and grant recipients.
These are the Foundation’s standard conditions to which we ask our partners and funding recipients to adhere. Please ensure that you have read these conditions prior to applying for funding from us and if there is anything that will be difficult for your organisation to comply with, please do let us know. We want to be as flexible as we can in the way we work with our partners.
Your grant:
- Your grant from the Foundation is to be used only for the purposes outlined in your application and as stated in your Funding Offer.
- In addition to these Funding Conditions, your Funding Offer may outline some deliverables or outcomes that are unique to your partnership with us. These will have been agreed with you as part of the project or partnership development process. By accepting payment from the Foundation, you confirm your acceptance of the conditions within the Funding Offer and these standard Funding Conditions.
- To confirm your acceptance of your Funding Offer from the Foundation and before we can release payment, you will be asked to sign and return to us a Funding Acceptance form and an A1 form. The A1 form is a requirement of the Liechtenstein Supervisory Authoritywith whom we are required by law to share certain informationabout our Funding programme.
- The Foundation’s reference currency is EUR and grants are typically paid in this currency. If this does not suit your purposes this should be stipulated clearly in your application, along with the rationale for the proposed currency.
- If there are any significant changes to your project as originally outlined or if a project is cancelled or otherwise not implemented, you must inform us as soon as possible. We will do our best to support you, but we do reserve the right to review the Funding Offer and, should a project not go ahead, we reserve the right to claim back any grants already paid out.
- You must inform the Foundation promptly if, at any time during the period covered by our funding, your organisation, or third party contractors involved in the project supported by our funding are the subject of any formal enquiry conducted by a legal or regulatory body (including safeguarding incidents) or if there are reports of criminal or negligent activity committed by the organisation or any of its staff or contractors. In such cases we reserve the right to delay payment or to withdraw our funding altogether, and to ask for our name to be removed from all materials.
- The Foundation is bound by the regulations of the Liechtenstein Supervisory Aauthorityies, which currently forbidsthe distribution of Foundation funds to Russia and Belarus, or to citizens of Belarus and Russia or if there is any other connection to Belarus and/or Russia. You must inform the Foundation promptly if the project we are funding is likely to be in breach of this regulation. In such cases we reserve the right to delay payment or to withdraw our funding altogether, and to ask for our nameto be removed from all materials.
Alignment with the values of the Foundation
- It is important to us that the values of your organisation and those of the funded project(s) align with the values of the Foundation. We expect our partners to take their safeguarding responsibilities seriously, to promote equality of opportunity and to embrace diversity and wellbeing amongst staff, artists and audiences. If we become concerned that our values are no longer aligned, we will raise these concerns with you directly and, if our concerns remain unresolved, we reserve the right to withdraw funding and to ask for our name to be removed from all material.
- In turn, we work collaboratively with partners and strive to be flexible, supportive and inclusive in all aspects of our work with you. We will be happy to discuss adjustments that might be required in our processes to support this. We also invite you to raise directly with us any concerns about our adherence to our own values.
- The Foundation seeks to serve as a convenor and, where appropriate, to make connections between our grant recipients and partners in pursuit of our shared ambitions. We may, from time to time, invite you to engage in dialogue with other grant recipients and partners whose interests and priorities align with yours.
Reporting
We ask partners and grant recipients to produce reports on the funded activities. These reports help us monitor the development of the funded projects and to understand how, through your work, the Foundation is delivering against our own aims and how we might improve our own funding processes and decisions.
We understand that report writing takes time and we do not wish to place undue demands on our partners. If you have already produced, for another funder, a report for the work we are funding, please feel free to adapt or reuse what you have already produced.
We welcome transparency and candour in your reporting, and we will always aim to have direct conversations with you as part of the reporting process.
- Annual progress reports: If your funding period covers more than one year, you must submit a progress report towards the end of each year of the period of your funding (in this context, year one1begins at the first payment date indicated on your Funding Acceptance form). Progress reports must be in MS word format and no longer than four4sides of A4. Please include a brief update on progress against the original project plan, highlight any learnings, share opportunities and challenges arising and outline next steps. Please include any digital images that help bring the work to life for the Foundation.
- Final report: You must submit a final report no later than six months from the date of project or partnership completion. This must be in MS Word format and be no longer than four4sides of A4. This final report must outline the outcomes of the project, relating them to the aims originally stated in the application. Again, please include any digital images or video clips that help bring the work to life.
Communications and publicity
- You must acknowledge the Foundation’s support in any relevant published or public communication. Once you have accepted your Funding Offer the Foundation will provide you with our logo and a standard text.
- Any communication or media release by you relating to the Foundation and your Funding from us should be approved in advance by The Foundation.
- In order that we can highlight your work on the Foundation website we will, once you have accepted your Funding Offer and again at the end of our funding period, ask you to provide us with a short, written article and an image and/or short video clip to illustrate the work we are funding. The Foundation Manager will provide you with the template for submitting this material.
- The Foundation will support you with your communications through amplifying and hosting your work and sharing your work with our partners. If there is anything you would like us to know about or to amplify to our partners, please get in touch with the Foundation Manager. All text will be agreed with you before publication.
Data protection
- By making an application or accepting funding from us you acknowledge that the Foundation will collect, process and use personal data made available to us only for the purpose of dealing with your application and for managing our ongoing relationship with you. We will hold this information for the duration of our relationship with you, or longer if required in order to comply with the law. You may request to inspect or to update that information at any time. Further details on the processing of personal data, including purposes, legal bases, retention periods and the rights of data subjects, are set out in the Foundation’s Privacy Notice.
- Neither party shall transfer or otherwise allow the use of Personal Data of the other party unless expressly instructed or authorised by the other party or if it is necessary by law. Any use or sharing of personal data is limited to what is necessaryfor the purposes of managing the funding relationship.
- Both parties shall comply with General Data Protection Regulation (EU) 2016/679 (“GDPR”) and any other applicable data protection laws, and appropriate technical and organisational measures relating to data privacy and data security.
Intellectual property
- Any protectable intellectual property created by you as a result of our funding or as part of our partnership is owned by you, as the recipient of the funding. We ask that you grant the Foundation a non-exclusive royalty free licence to use, in pursuit of its charitable objectives, agreed parts of any work produced as a result of the grant.
Dispute resolution & jurisdiction
- In the unlikely event that a disagreement arises between the Foundation and the funding recipient in relation to any of the conditions covered by the Funding Offer, both parties will make every effort to resolve the matter informally through direct conversation. If that informal approach fails to resolve the matter, then an appointed representative from each of the parties will, within 14 days of a written request from one party to the other, meet in a good faith effort to resolve the matter. If the dispute is not wholly resolved within 30 days of that meeting, the dispute shall be submitted by any party for final resolution by the courts in Liechtenstein, which courts shall thereafter have exclusive jurisdiction.
- The governing substantive law of this funding shall be the law of Liechtenstein, and the courts of Liechtenstein shall have sole jurisdiction if mediation does not resolve a dispute.
